Winning your case in a criminal court is only the first half of the battle for a foreign national in Korea. This is a separate administrative process where the Ministry of Justice decides if you are 'worthy' of staying in Korea despite your legal infraction.

1. What Exactly is Sabeom Simsa?

Sabeom Simsa is an investigation conducted by an immigration officer after a foreigner has violated any Korean law (Criminal Act, Immigration Act, etc.). Even if the prosecutor gives you a light fine or a 'Suspension of Indictment,' you MUST undergo this review. The goal is to determine whether your presence in Korea is a threat to public order or national interest.

2. The Four Possible Outcomes

The review results in one of four decisions:

  • Warning (Go-ji): You are allowed to stay but receive a formal warning on your record.
  • Fine (Beom-chik-geum): You must pay an administrative fine to maintain your status.
  • Departure Order (Chul-guk Myeong-ryeong): You are ordered to leave voluntarily within a set period.
  • Deportation Order (Gang-je Toego): You are forcibly removed and usually detained until the flight.

3. The 'Discretionary' Nature of the Review

Unlike a criminal trial, which follows strict rules of evidence, Sabeom Simsa is highly discretionary. The officer looks at your entire life in Korea: your employment, family ties, past record, and the 'nature' of your crime. This is where you can present humanitarian arguments to save your visa.
