When a rental property is damaged by a natural disaster (like heavy rain flooding) or a fire, disputes over repair costs and liability can become legally complex. Under Korean law, the primary responsibility for maintenance lies with the landlord, but this changes if the tenant's negligence is involved.

1. The Landlord’s 'Duty to Repair'

Under Article 623 of the Civil Act, the landlord has a fundamental duty to maintain the property in a state suitable for the tenant's use. If a house becomes uninhabitable due to heavy rain flooding or a fire caused by faulty electrical wiring (an internal facility issue), the Landlord MUST pay for all repairs and potentially provide temporary housing.

2. When is the Tenant Liable?

If a fire or water damage is caused by the tenant's negligence, the responsibility flips. Common examples include:

  • Leaving a stove on and causing a kitchen fire.
  • Using an unauthorized, high-wattage space heater that causes an electrical fire.
  • Forgetting to close windows during a typhoon, leading to significant water damage. In these cases, the tenant is liable for the damages to the unit and potentially to the entire building and neighbors' properties.

3. The 'Duty to Notify' (Article 634)

If you notice a small leak or a flickering electrical outlet, you MUST notify the landlord immediately. If you fail to do so and it leads to a major disaster, the court may hold you partially liable for the increased damages because you breached your legal duty to report the issue.

4. Rent Reduction During Repairs

If a portion of the house is unusable due to damage not caused by the tenant, the tenant has the legal right to request a Rent Reduction (Im-dae-ryo Gam-aek Cheon-gu) proportional to the lost usability of the space.
