In 2020, Korea introduced the 'Contract Renewal Request Right' to provide greater housing stability for tenants. This rule, commonly known as the '2+2 Rule,' allows a tenant to extend their original 2-year lease for another 2 years. Understanding how to exercise this right is essential for long-term expatriates.

1. How to Exercise Your Right

You must notify the landlord of your intent to exercise the renewal right between 6 months and 2 months before your current contract expires. To ensure legal validity, it is highly recommended to send this notice via KakaoTalk, Email, or Content Certification (Naeyong Jeungmyeong) to have proof of the date.

2. The 5% Rent Increase Cap

When you exercise your renewal right, the landlord cannot raise the rent or deposit by more than 5%. Even if your original contract had a higher increase clause, the 5% cap mandated by the Housing Lease Protection Act takes precedence.

3. When Can a Landlord Refuse?

The landlord can legally deny your request in only a few specific cases:

  • Landlord’s Occupation: If the landlord or their immediate family (parents or children) intends to live in the property.
  • Unpaid Rent: If the tenant has missed rent payments for 2 months or more.
  • Unauthorized Subleasing: If the tenant subleased the property without consent.

4. Right to Terminate Anytime

A unique advantage of the renewed contract for the tenant is the right to terminate the lease at any time. Once you notify the landlord, the contract ends exactly 3 months later. During this period, the landlord is responsible for the brokerage fee for the new tenant.
