Table of Contents

Foreign instructors on E-2 visas often face unique challenges in the Korean labor market. While many hagwons are reputable, wage arrears and sudden dismissals remain significant issues. Understanding your rights under the Labor Standards Act (LSA) is essential for any expatriate educator.

1. Determining 'Employee Status' (The Freelancer Trap)

Many academies try to label instructors as 'independent contractors' or 'freelancers' to avoid paying severance or insurance. However, the Korean Supreme Court prioritizes the 'substance of the relationship' over the contract title. If the hagwon dictates your schedule, curriculum, and provides teaching materials, you are likely an 'employee' protected by the LSA.

2. Unpaid Wages & Premium Pay

Under the LSA, if your hagwon has 5 or more employees, you are entitled to a 50% premium for overtime (over 8 hours a day or 40 hours a week), night work, and holiday work. For smaller hagwons (fewer than 5), the premium doesn't apply, but every single hour worked must be paid at least the minimum wage.

3. Wrongful Termination & The 30-Day Rule

A landlord (hagwon owner) cannot fire you without 'just cause.' Minor performance issues usually do not meet this bar. Furthermore, the employer MUST provide 30 days' notice or pay 30 days' worth of wages as a 'Dismissal Notice Allowance.'

4. Essential Evidence Checklist

If you find yourself in a dispute, immediately gather:

  • Signed Employment Contract
  • Pay stubs or bank transfer history (Avoid cash payments if possible)
  • KakaoTalk or Email logs regarding work instructions
  • Attendance records or class schedules
