For a foreign tenant in Korea, 'Opposing Power' (Dae-hang-ryeok) is your legal armor. It is the right to remain in your home until the lease ends and the right to get your deposit back even if the house is sold or auctioned. Maintaining this power is a continuous requirement, not a one-time task.

1. Acquiring Your Armor: Move-In + Residence Report

Your Opposing Power begins at midnight of the day after you complete two steps:

  • Taking physical possession (moving in and getting the keys).
  • Reporting your change of residence to the local Immigration Office or community center. Crucial: If you have the keys but haven't reported your address, or if you reported your address but haven't moved in, you have ZERO Opposing Power.

2. Securing Your Rank: The Fixed Date (Hakjeong-ilja)

While Opposing Power lets you stay in the house, the Fixed Date determines where you stand in the 'money line' if the house is auctioned. By getting a confirmed date stamp on your lease, you gain a 'Priority Repayment Right.' This ensures you are paid before any creditors who register their rights after your fixed date.

3. The 'Continuity' Trap: Never Leave Without Protection

The most dangerous mistake foreigners make is moving their residence registration out temporarily (e.g., to help a friend or for a visa issue) while still living in the house. 4. What if the Building Changes Owners?

If you have properly established your Opposing Power, the new owner is legally forced to take over the old landlord's obligations. Your contract remains 100% valid. You do not need to sign a new contract, and you can demand your deposit from the new owner at the end of the term.
